HOLLYWOOD ENTERTAINMENT CORPORATION, TOGETHER WITH ITS SUBSIDIARIES AND AFFILIATES (“Hollywood Video”) PROVIDES YOU ACCESS AND USE OF THIS WEBSITE (the “Site”), SUBJECT TO YOUR COMPLIANCE WITH THESE TERMS AND CONDITIONS OF USE (the “Site Terms”). BY ACCESSING, BROWSING, AND USING THIS SITE YOU AGREE TO BE BOUND BY THE SITE TERMS AND ALL APPLICABLE LAW. IF YOU DO NOT AGREE TO BE BOUND BY THE SITE TERMS AND APPLICABLE LAW EACH TIME YOU USE THIS SITE, YOU MAY NOT USE THE SITE.

Modification of Site Terms
Hollywood Video reserves the right to modify these Site Terms in our sole discretion from time to time. If the Site Terms are changed, we will post the new terms on the Site and note the date they were last updated. Changes, Misprints, Errors and Cancellations
This Site may include inaccuracies or typographical errors that may be corrected as they are discovered at Hollywood Video’s sole discretion.

Subject to applicable law, we: (a) reserve the right to change the goods and services advertised or offered for sale through this Site, the prices or specifications of such goods and services, and any promotional offers and any other Site Materials at any time, and from time to time without any notice or liability to you or any other person; (b) cannot guarantee that goods or services advertised or offered for sale on this Site will be available when ordered or thereafter; (c) reserve the right to limit quantities sold or made available for sale; (d) do not warrant that the Site Materials (including, without limitation, product descriptions or photographs) are accurate, complete, reliable, current, or error-free; and (e) reserve the right to cancel, to terminate or not to process orders (including accepted orders) where the price or other material information on this site is inaccurate or when we recognize abuse of our policies. If we do not process an order for such reason, we will advise you that the order has been cancelled and will eion may not apply to you.

In addition, all page headers, custom graphics, button icons, and scripts are trademarks, and/or trade dress of Hollywood Video, and may not be copied, imitated, or used, in whole or in part, without the prior written permission of Hollywood Video. All other trademarks, registered trademarks, product names, and company names or logos mentioned herein are the property of their respective owners.

Hollywood Video hereby grants you a personal, non-exclusive, non-assignable and non-transferable license to use and display the Materials for noncommercial and personal use only; provided that you maintain all copyright and other notices contained in such Materials. You agree not to reproduce, modify, create derivative works from, display, perform, distribute, disseminate, broadcast or circulate any Materials to any third party (including, without limitation, the display and distribution of Materials via a third part web site) without express prior written consent of Hollywood Video. Use of Materials is only permitted with the express written permission of Hollywood Video and/or its licensors. You further agree that you will not disassemble, decompile, reverse engineer or otherwise modify the Materials.

This Section will survive the termination of your right to use this Site.

Notice and Procedure for Making Claims of Copyright Infringement
If you believe that your work has been copied in a way that constitutes copyright infringement, please provide Hollywood Video's copyright agent the written information specified below. Please note that this procedure is exclusively for notifying Hollywood Video and its affiliates that your copyrighted material has been infringed. (1) An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest; (2) A description of the copyrighted work that you claim has been infringed upon; (3) A description of where the material that you claim is infringing is located on the Site; (4) Your address, telephone number, and e-mail address; (5) A statement by you that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and (6) A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

If you use a password to access this Site or any portion of it, you are responsible for maintaining the confidentiality of the password and for restricting access to your computer. In the event that the confidentiality of your account or password is compromised in any manner, you will notify Hollywood Video immediately. Applicable Law, Venue and Limitation of Actions
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Alabama applicable to agreements made and entirely to be performed within Alabama, without resort to its conflict of law provisions. Regardless of where you access this site, you agree that any action at law or inequity arising out of or relating to these terms and conditions shall be filed and adjudicated only in the federal or state courts located in Houston County, Alabama, and you hereby irrevocably and unconditionally consent and submit to the exclusive jurisdiction and venue of such courts over any suit, action, or proceeding arising out of these terms and conditions.

Termination
Hollywood Video reserves the right, without notice, and in its sole discretion, to block or prevent future access to and use of this Site if you violate any of these Site Terms or its policies.

Consent to Email Communication
When you visit this Site or send email to us, you are communicating with us electronically. You consent to receive communications from us electronically, and agree that we may communicate with you by email or by posting notices on this web site.

Severability
If any provision of the Site Terms and Conditions is found to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed to be severed from the rest of these Site Terms, and shall not affect the validity and enforceability of any remaining provisions.

Waivers
No waiver, express or implied, by either party of any breach of or default under these Site Terms and Conditions will constitute a continuing waiver of such breach or default or be deemed to be a waiver of any preceding or subsequent breach or default.

HOLLYWOOD VIDEO ECOMMERCE (PURCHASE TERMS AND CONDITIONS)
You may purchase both new and used DVDs (each a “Retail Product”) through the Hollywood Video eCommerce website. In order to purchase a Retail Product, you must be a Registered Site User. In addition to the overall Terms and Conditions for general Site use, your purchase of a Retail Product is subject to the following additional terms and conditions (the “eCommerce Terms and Conditions”). Purchase of a Retail Product constitutes your acceptance of these eCommerce Terms and Conditions. If you do not wish to accept these eCommerce Terms and Conditions, do not purchase a Retail Product.

Payment Methods
Hollywood Video eCommerce will accept only the following major credit cards for purchases of Retail Product: MasterCard, Visa, Discover and American Express. In addition, Hollywood Video eCommerce will accept check cards issued by MasterCard, Visa, Discover and American Express. These payment methods are referred to as “Retail Payment Method”).

Electronic checks will not be accepted for Retail Purchases at this time. We are sorry, but cash on delivery (COD) is not available for purchases of Retail Product.

Your Retail Payment Method will be charged when your order is shipped. You will be charged for the total cost of the items, plus all applicable taxes and shipping and handling.

If a Retail Product you ordered is not available, we will continue to attempt to fulfill your order for 6 days. We will notify you by email that your order is on backorder. You will have the option to cancel your order and receive a refund. On the 4th and 5th days you will receive an email notifying you that the product is still backordered and notifying you that you still have the option to cancel for a refund. If we are still unable to fulfill your order by the 6th day, we will automatically cancel the order and issue a refund to the Retail Payment Method used for your order. If we are unable to process the refund, we will contact you via the email address you provided at the time of purchase. Therefore, it is important that you make sure we have your current e-mail address.

Hollywood Video reserves the right to change the Retail Payment Methods accepted at any time, at its sole discretion, without prior notice.

Sale Tax
In accordance with applicable state and local laws, we are required to charge sales tax in localities where Hollywood Video has operations. Hollywood Video does not benefit from the collection of sales tax, and we remit all taxes collected directly to the appropriate taxing jurisdiction. As a general rule, it is the laws of the state of delivery that determine whether sales tax will be due on your transaction. The appropriate sales tax amount will be displayed on the check out section of the site.

Be advised that, because Hollywood Video’s shipping and handling charge is a combined charge, this charge is subject to sales tax in many of the states where a separately stated shipping charge might normally be nontaxable.

Condition of Used Product
Retail Products sold as "Used" is previously viewed products that have been used for rental at Hollywood Video stores. Used Retail Products: (1) Will not be shrink wrapped or in new condition; (2) will be inspected for any damage prior to being shipped to you; and (3) will be in a hard DVD case.

Shipping and Delivery
Orders will ship either by United States Postal Service (“USPS”), FedEx or UPS, depending on the shipping method you select at checkout. Shipping and handling costs are charged per item, and are not based on delivery location. If you enter a promotional code for shipping when you check out but elect to use a more expensive shipping option than is covered by the promotional code, we will apply the promotional code discount and charge you any remaining balance for shipping and handling costs.

After you have placed your order, we will send you an email confirming your order with an order summary, including the items you purchased and a purchase total. We will send you an email when your order ships with a tracking number. If your order is sent in multiple shipments, you will receive a separate notification for each shipment. Each notification will contain a hyperlinked tracking number for your reference. Orders containing multiple items may be shipped from multiple distribution centers. You may receive more than one package for a single order.

We cannot ship to multiple addresses for the same order. If you want to ship items to multiple addresses, you must place a separate order for each shipping address.

If your order is undeliverable, it will be returned to us, and we will notify you via the email address provided at checkout that your order could not be delivered. We will automatically refund the cost of the order, excluding shipping and handling charges, to the Retail Payment Method used on the order. Therefore, it is important that you provide us with your current e-mail address at all times.

Delivery Estimates
Our delivery estimates are based on several factors, including your destination address, how quickly we can process items for shipment, product availability, and the method of shipment chosen. Orders for multiple items or multiple copies of a single item can take longer to assemble before we are able to ship them to you.

Expected Delivery Times
Orders will generally ship within 24 to 48 hours from the time of purchase. Expected transit times for each shipping method are listed below.

Standard Ground U.S.: 3 to 14 days after shipping
Second Day Expedited U.S.: 2 to 3 days after shipping

Since we use more that one distribution center, you may receive more than one package for your order. The estimated delivery window should cover the entire time for your complete order to arrive to the designated shipping address. Specific delivery detail by unit will be available under ‘My Account Page’ and tracking by unit will be e-mailed upon shipment.

2nd day expedited orders will have a tracking number attached. This tracking number is included in the shipment confirmation email and in the My Account Page.

If the tracking information indicates the package has been delivered, please check with your neighbors or family members. Packages are occasionally left with neighbors, a building manager, or are placed somewhere relatively safe such as your porch, garage, or even behind bushes.
If the tracking information indicates the package is being returned to us, or if the address is incorrect, it may have been undeliverable.

Return Mailing Label
The return mailing labels obtained from our online Returns Center are valid only for returns shipped within the United States. Each return mailing label is coded for a specific shipment. Please do not include items from other orders, or other shipments from the same order in the same box, or you will not receive the correct refund. Each shipment must be returned using a separate mailing label. If you use this mailing label and the return is a result of our error (you received an incorrect or defective item, etc.), we'll pay the return shipping costs. If you use this mailing label and your return is not the result of our error, the shipping cost of that returned item will be deducted from your refund. The amount deducted will be equivalent to our standard shipping cost for that item.

Our security measures are designed to prevent anyone from stealing and using your credit card number. In addition, consumer protection laws protect you against the unauthorized use of your credit card. In the event of unauthorized use of your credit card, you must notify your credit card provider in accordance with its reporting rules and procedures.

Correction of Errors and Inaccuracies
The information on this web site may contain typographical errors or inaccuracies, and may not be complete or current. We therefore reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information at any time, without prior notice (including after you have submitted your order). Please note that such errors, inaccuracies, or omissions may relate to product description, pricing, and availability. We apologize for any inconvenience this may cause you. Hollywood Video shall have the right to refuse or cancel any such orders, whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, Hollywood Video shall issue a credit to your credit card account in the amount of your original charge.

Mispriced Items
Despite our best efforts, a small number of the items on our web site may be mispriced. Rest assured, however, that we verify prices as part of our shipping procedures. If an item's correct price is lower than our stated price, we charge the lower amount, and ship you the item. If an item's correct price is higher than our stated price, we will, at our discretion, either contact you for instructions before shipping, or cancel your order and notify you of such cancellation.

Price Matching
Regular, sale and clearance prices for products on Hollywoodvideo.com may vary from Hollywood Video stores. We do not match the price of our online merchandise with the price offered by Hollywood Video stores or another company, and Hollywood Video stores do not match the price of our online merchandise.

Confirmed Prices
We cannot confirm the price of an item until your order enters the shipping process, nor will we charge your credit card until your order enters the shipping process. (Please note that your Order Acknowledgement means that your order request has been received; it does not mean that your order has been shipped or that the price of an item has been confirmed.)

Returns
We will accept returns of a Retail Product as set forth below as long as you contact us within 30 days of your delivery date and obtain a Return Mailing Label, which must be included with your return shipment. This Return Mailing Label will be provided to you by our Online Return Center when you complete your return request. If your Retail Product is sent to us without a Return Mailing Label, it cannot be processed. All refunds are made to the Retail Payment Method used for the original purchase.

We will accept returns of new, unopened Retail Products in the original shipping condition. We will refund the cost of the items, but not shipping and handling charges. You will be required to pay the cost of returning the item.

We will accept returns of new or used Retail Products that are damaged or defective (or an incorrect Retail Product if unopened). You will not be required to pay the cost of returning the Retail Product as long as it is returned in accordance with our Online Return Center policies.

Items purchased at Hollywood Video store locations may not be returned through the Hollywood Video eCommerce web site. Items purchased through Hollywood Video eCommerce may not be returned to a Hollywood Video store. For more information on returns, please contact Customer Support.

Original Packing Slip Required for All Returns
Please note that all returns must include the Return Mailing Label.
To return or exchange an item, please follow these simple steps:

Contact our Return Center at, help@websales@hlyw.com to begin processing your return or exchange.
Repack the item in its original packaging with the packing slip. Use the return label provided by us. Please be sure your Order ID is on the return label for fast processing.

For your convenience, the cost of return shipping will be deducted from your refund amount. If the return is a result of our error, you won't be charged for return shipping. Return Mailing Labels created in our Online Returns Center are valid for domestic returns only.

Exchange Policy
While we can replace damaged or defective merchandise, we can't exchange items. In order to get exactly what you want as quickly as possible, simply return the unwanted item through our online Returns Center (you will be refunded your original purchase price once we receive the item), and place another order for the item you wish to purchase. You do not have to wait for us to receive the original item before placing the new order. We're unable to honor previous sale prices or promotions when you place your new order.
